What is General Data Protection Regulation (GDPR) and The Data Protection Bill (DPB)?

General Data Protection Regulation (GDPR) is a new privacy regulation, implemented across the European Union. It provides individuals with more control over their personal data, ensures transparency and accountability around the use of their data, and requires appropriate security and controls to protect their data. The regulation becomes enforceable from 25th May 2018.

The Data Protection Bill (DPB) was announced in the Queen’s Speech on 21 June 2017. The Bill updates data protection laws in the UK, supplementing the General Data Protection Regulation (EU) 2016/679 (GDPR), implementing the EU Law Enforcement Directive, as well as extending data protection laws to areas which are not covered by the GDPR. It is intended to provide a comprehensive package to protect personal data.

What do you need to know about OurDPO?

Do we require a DPO?

Yes, on a mandatory basis, if you fit any of the following 3 criteria (you can also appoint one voluntarily):

  • Where the processing is carried out by a public authority or body;
  • Where the “core activities” of the controller or processor consist of processing operations which require regular and systematic monitoring” of data subjects on a “large scale”; or
  • Where the “core activities” of the controller or processor consist of processing on a “large scale” of “special categories of personal data” or data relating to criminal convictions and offences.

What’s included?

  • Be the first point of contact for supervisory authorities and for individuals whose data is processed (employees, customers etc).
  • The monitoring of compliance with the GDPR and other data protection laws, including managing internal data protection activities, advising on data protection impact assessments; training staff and conducting internal audits.
  • Informing and advising the organisation and its employees about their obligations to comply with the GDPR and other data protection laws.

  • Provide updates on the data protection compliance programme to Board and Management;
  • Participate in relevant working groups;
  • Professional reporting & accountability at board level;
